वर्शिप एक्ट के दायरे में क्यों नहीं ज्ञानवापी- श्रृंगार गौरी केस?
काशी के ज्ञानवापी-श्रृंगार गौरी केस में वाराणसी के जिला कोर्ट के फैसले बाद अब इस पूरे मामले की तुलना अयोध्या के बाबरी मस्जिद मामले से होने लगी है। सोमवार को हिंदू पक्ष की याचिका पर सुनवाई करते हुए जिला जज अजय कृष्णा विश्वेश ने केस को सुनवाई के लायक माना, वहीं कोर्ट ने अपने फैसले में कहा कि 1991 का वर्शिप एक्ट ज्ञानवापी पर नहीं लागू होता है। मुस्लिम पक्ष ने अपनी याचिका में 1991 के वर्शिप एक्ट का हवाला देकर परिसर में दर्शन-पूजन की अनुमति पर आपत्ति जताई थी।
वाराणसी जिला कोर्ट के फैसले के बाद एमआईएम चीफ असदुद्दीन ओवैसी ने कहा कि ज्ञानवापी मस्जिद का केस बाबरी मस्जिद के रास्ते पर जाता दिख रहा है और ऐसे तो देश में 80-90 के दशक में वापस चला जाएगा। वहीं ओवैसी ने वाराणसी जिला कोर्ट के आदेश पर चिंता जताते हुए कहा कि इस तरह के फैसले से 1991 के वर्शिप एक्ट का मतलब ही खत्म हो जाता है।
क्या है 1991 का वर्शिप एक्ट?-1991 में तत्कालीन प्रधानमंत्री पीवी नरसिम्हाराव की सरकार ने देश के पूजा स्थलों की सुरक्षा के लिए एक कानून प्लेसेज ऑफ वर्शिप एक्ट, 1991 (THE PLACES OF WORSHIP ACT, 1991) बनाया था, जिसके मुताबिक 15 अगस्त 1947 के बाद देश में किसी भी धार्मिक स्थल के स्वरूप को बदला नहीं जाएगा। एक्ट के मुताबिक 15 अगस्त 1947 जैसी स्थिति हर धार्मिक स्थल की रहेगी इसके मुताबिक अगर 15 अगस्त 1947 को कहीं मंदिर है तो वो मंदिर ही रहेगा और कहीं मस्जिद है तो वो मस्जिद ही रहेगी।

ज्ञानवापी पर हिंदू पक्ष का दावा-वाराणसी के ज्ञानवापी मस्जिद में उस जगह शिवलिंग मिलने का दावा किया गया है जहां नमाज से पहले वजू किया जाता है। ‘वेबदुनिया’ से बातचीत में अयोध्या में राममंदिर आंदोलन के प्रमुख चेहरे प्रवीण तोगड़िया कहते हैं कि इतिहास में इस बात के एक नहीं, कई प्रमाण मौजूद है कि काशी में विश्वनाथ मंदिर को कई बार तोड़ा गया। मुगल शासन काल में 1669 में मुगल शासक औरंगजेब ने काशी विश्वनाथ मंदिर को तोड़ा और वहां मस्जिद बनी। इसके साथ वाराणसी जिला कोर्ट के आदेश पर हुए सर्वे में वुजू वाले स्थान (नमाज से पहले हाथ-पैर धोने वाला स्थान) से 12 फुट व्यास वाला शिवलिंग मिला है औऱ इस तरह काशी विश्वनाथ मंदिर में जो नंदी भगवान बैठे है, उससे 80 फीट दूर शिवलिंग मिला है।
ज्ञानवापी की बाबरी से तुलना क्यों?-ज्ञानवापी केस में कोर्ट के फैसले के बाद मुस्लिम पक्ष का आरोप है कि ज्ञानवापी को बाबरी मस्जिद की तरह मिटाने की साजिश हो रही है। ज्ञानवापी की तरह ही 1949 में अयोध्या में रामलला की मूर्ति मिलने का दावा किया गया था। अयोध्या में बाबरी मस्जिद की जगह रामजन्मभूमि और मंदिर होने का दावा कर हिन्दुओं ने पूजा-पाठ करने की मांग करते हुए कोर्ट का सहारा लिया था। कोर्ट में मामले के दौरान ही 6 दिसंबर 1992 को बाबरी मस्जिद के विवादित ढांचे को ढहा दिया गया था।
वहीं 1991 में अयोध्या में बाबरी मस्जिद विवाद के समय ही काशी विश्वनाथ मंदिर और ज्ञानवापी मस्जिद मामले में पहला केस वाराणसी जिला कोर्ट में दाखिल हुआ था जिसमें ज्ञानवापी परिसर में पूजा की अनुमति मांगी गई थी। उसी वक्त अयोध्या में राममंदिर विवाद के बीच केंद्र सरकार की ओर से वर्शिप एक्ट (धर्मस्थल कानून) बनाए जाने से मामला ठंडे बस्ते में चला गया था। अब वाराणसी जिला कोर्ट के फैसले के बाद एक बार फिर मामला कोर्ट में पहुंच गया है।
सर्वे में शिवलिंग मिलने की बात-ज्ञानवापी परिसर में कोर्ट के आदेश पर हुए सर्वे में मस्जिद के ऊपरी हिस्से में वजू करने वाले स्थान पर बने तालाब में तालाब में शिवलिंग मिलने का दावा किया जा रहा है। कोर्ट के आदेश पर हुए सर्वे में शिवलिंग मिलने की बात सामने आने के बाद कोर्ट के आदेश पर वाराणसी जिला प्रशासन को शिवलिंग मिलने वाली जगह को सील कर दिया है।
दरअसल ज्ञानवापी मस्जिद के बिलकुल बगल में काशी विश्वनाथ मंदिर है। ऐसा कहा जाता है कि औरंगजेब ने मंदिर को तोड़कर मस्जिद बनवाई और पूरा विवाद इसी बात को लेकर है। हिन्दू पक्ष का दावा है कि मस्जिद के नीचे 100 फीट ऊंचा आदि विश्वेश्वर का स्वयंभू ज्योतिर्लिंग है।
क्या कहते हैं कि एक्सपर्ट?- बाबरी मस्जिद विंध्वस और राजजन्मभूमि विवाद को कई दशकों तक कवर करने वाले वरिष्ठ पत्रकार और लीगल एक्सपर्ट रामदत्त त्रिपाठी कहते हैं कि वाराणसी में ज्ञानवापी और अयोध्या में बाबरी का विवाद बहुत कुछ एक जैसा है। अयोध्या में भी पूजा के अधिकार को लेकर लड़ाई शुरु हुई थी, जैसा की ज्ञानवपी-श्रृंगार गौरी की पूजा को लेकर लड़ाई शुरु हुई है।
वहीं रामदत्त त्रिपाठी कहते हैं कि अयोध्या और ज्ञानवापी में बड़ा अंतर यह है कि अयोध्या में हिंदू पक्ष का दावा बहुत कुछ कल्पना या अनुमान (abstract) पर आधारित था लेकिन ज्ञानवापी में कुछ भी साबित नहीं करना है। ज्ञानवापी की पीछे की दीवारों में मंदिर से जुड़े तमाम साक्ष्य मौजूद है और ऐसे में बहुत से प्रमाण मौजूद है कि मंदिर को तोड़कर मस्जिद बनाई गई। अयोध्या केस में एक म्यान में तो तलवार जैसा मामला था लेकिन वाराणसी में तो एक भव्य मंदिर पहले से बना है। सवाल ज्ञानवापी का नहीं है, सवाल यह है कि ऐसे कितनों को बदला जाएगा और संसद के बनाए कानून 1991 के वर्शिप एक्ट का क्या होगा?
रामदत्त त्रिपाठी कहते हैं कि वाराणसी के ज्ञानवापी में मौजूदा समय में दो केस कोर्ट में है। पहला केस वाराणसी जिला कोर्ट में श्रृंगार गौरी की पूजा को लेकर था जिसको सोमवार को जिला कोर्ट ने सुनवाई के लिए स्वीकार किया है। वहीं एक अन्य केस इलाहाबाद हाईकोर्ट में है जो मस्जिद पर स्वामित्व को लेकर है, जिस पर 28 सितंबर को संभवत सुनवाई होनी है।
ज्ञानवापी-श्रृंगार गौरी केस को वर्शिप एक्ट के दायरे में नहीं आने के जिला कोर्ट के फैसले पर रामदत्त त्रिपाठी कहते हैं कि उनके नजरिए से कोर्ट का फैसला सहीं है क्योंकि याचिका में पूजा के अधिकार की बात कहीं गई जब वर्शिप एक्ट स्वामित्व और स्थान का स्वरूप बदलने को लेकर है। वहीं कोर्ट ने याचिका को अभी स्वीकार किया है उस पर कोई फैसला नहीं सुनाया है।
