तुम्हारे रेप के लिए तुम खुद जिम्मेदार, जज की टिप्पणी से फिर मचा बवाल
Allahabad HC News: No means NO! अमिताभ बच्चन और तापसी पन्नू स्टारर मूवी पिंक के इस डायलोग ने भले ही सेक्स के मामले में किसी महिला की सहमति को ज़रूरी बताया हो लेकिन इसके उलट इलाहाबाद हाईकोर्ट ने रेप केस के एक मामले में सुनवाई के दौरान पीड़िता को ही रेप के लिए दोषी कह दिया। इलाहाबाद हाईकोर्ट के जज संजय कुमार ने ये कहते हुए दोषियों की जमानत मंजूर कर दी कि जब देर रात 3 बजे तक बार में शराब पी कर पीड़िता अपने पुरुष मित्र के फ्लैट पर गई क्या तब उसे इतनी समझ नहीं थी कि उसके साथ कुछ गलत हो सकता है। इसलिए जज साहब ने पीड़िता को ये कहते हुए फटकारा कि वह खुद भी अपने रेप के लिए जिम्मेदार है।
जज साहब की टिप्पणी से मचा बवाल
अदालत की इस टिप्पणी ने महिला सुरक्षा के सन्दर्भ में भारतीय न्याय प्रणाली में कोर्ट की भूमिका को फिर एक बार कटघरे में ला कर खड़ा कर दिया है। अब जज साहब ने क्या सोच कर ये बेतुकी बात कही ये नहीं कहा जा सकता लेकिन सवाल ये है कि हाल के केस में उनकी टिप्पणी जो आरोपियों के लिए जमानत का जरिया बनी है क्या अपराधों के लिए रियायत का जरिया बन सकती है!
ये है पूरा मामला
दिल्ली के हौज खास इलाके में बने एक बार में निश्चल चंदक की मुलाकात एक लड़की से होती है जहां वे साथ में शराब पीते हैं। निश्चल पर आरोप है कि उसने शराब के नशे में लड़की को अपने घर चलने के लिए कहा। लड़की को नोएडा में अपने घर ले जाने के बजाए वह उसे गुड़गांव में अपने रिश्तेदार के फ्लैट पर ले गया जहां उसने लड़की के साथ बलात्कार किया।
क्या बदल रहा है कोर्ट का नजरिया
“क़त्ल होने ख़ुद ही क़ातिल के मकाँ तक आ गए
ज़िंदगी की जुस्तुजू में हम कहाँ तक आ गए”
महिला अपराधों के खिलाफ अपराधियों को दोषी करार दिए जाने और उन्हें सजा दिलवाने तक का सफर न्याय प्रणाली के नजरिये पर निर्भर करता है। कानून तो बाद में बनते और बदलते हैं। सबसे पहले जरूरी ये तय होना कि हमारी न्याय व्यवस्था महिलाओं की सुरक्षा के प्रति कितनी संवेदनशील है। हाल के केस में कोर्ट की इस टिप्पणी से पीड़िता को उसके साथ हुए अत्याचार के लिए दोषी ठहराया गया। सवाल यह है कि जिस अदालत में वह न्याय के लिए गई वहां अपराधी को सजा देने के बजाय उस पर ही दोष मढ़ दिया गया।
कुछ दिनों पहले ही इलाहाबाद हाईकोर्ट ने एक नाबालिग छात्रा के साथ बलात्कार के मामले में एक बेहद संवेदनहीन बात कही। अदालत का कहना था कि लड़की के स्तन पकड़ना और पजामी का नाड़ा तोड़ना बलात्कार की श्रेणी में नहीं आता। इस टिप्पणी के बाद पूरे देश में ये बहस शुरू हो गई थी कि क्या हमारी प्रणाली महिलाओं के खिलाफ हो रहे अपराधों और अत्याचारों को गंभीरता से ले रही है?
इन दोनों मामलों में अदालतों ने आरोपी के बजाय पीड़िता की भूमिका पर अधिक ध्यान दिया। सवाल ये है कि क्या भारत की अदालतों की ओर से जारी इन टिप्पणियों से अपराधियों के हौसलों को बल नहीं मिलेगा? क्या हमारी न्याय प्रणाली की ऐसी सोच महिला सुरक्षा और महिला सशक्तिकरण की बुनियाद को एक मजबूत आधार दे पाने में सक्षम होगी ? सवाल ये भी है कि क्या महिलाओं के खिलाफ अपराधों के केस में पीड़ितों को न्याय दिलाने के लिए हम सही दिशा पर आगे बढ़ रहे हैं?
रेप केस में अदालत की चौंकाती टिप्पणियां
- लड़की के स्तन पकड़ना, पजामे का नाड़ा तोड़ना रेप की प्रयास के अंतर्गत नहीं आता।
- इस स्थिति में आरोपियों पर रेप का मुकदमा नहीं बल्कि छेड़छाड़ और अश्लील हरकतों की धाराएं लगाई जाएंगी।
- मेडिकल रिपोर्ट में पीड़िता की हाइमन टूटी मिलने के बाद भी डॉक्टर ने यौन हिंसा को लेकर स्पष्ट राय नहीं दी।
- पीड़िता को अदालत की ओर से कहा गया कि उसे इतनी समझ थी कि वह अपने कार्यों के नतीजे समझ सके।
- पीड़िता से कहा गया कि उसने खुद मुसीबत को न्योता दिया।
- अदालत ने आरोपी को यह कहते हुए जमानत दे दी कि उसका कोई आपराधिक रिकॉर्ड नहीं है।
ऐसे फैसलों से कौन पाएगा राहत: पीड़िता या अत्याचारी
इन दोनों मामलों में अदालतों ने आरोपी के बजाय पीड़िता की भूमिका पर अधिक ध्यान दिया, जिससे यह सवाल उठता है कि क्या बलात्कार के मामले में सबसे अहम बात रहा है कि हम रेप को किस तरह से परिभाषित करते हैं। बलात्कार जैसे घृणित अपराध के बारे में अगर देश की उच्च अदालतों के नजरिये में लोच आ रहा है तो क्या ये महिला अत्याचारों के लिए अनुकूल माहौल तैयार नहीं करेगा? अदालत कैसे फैसले और टिप्पणी क्या अपराधियों को और निडर नहीं बनाएंगे? अगर कोर्ट महिला अपराधों के मामलों में सख्ती के बजाए उदार होकर फैसले लेने लगी तब क्या आने वाले समय में समाज अपनी महिलाओं और बच्चियों की सुरक्षा को लेकर आश्वस्त हो पाएगा?
क्या कहना है विशेषज्ञों का
कानूनी के जानकारों की राय में अगर देश की उच्च अदालतों से इस तरह की टिप्पणियों से साथ दोषियों की पैरवी की जाती रही तो महिलाओं के खिलाफ अपराध बढ़ सकते हैं। निचली अदालतों में इनका हवाला देकर वकील अपने मुवक्किलों के लिए जमानत मांग सकते हैं। अदालतें अगर महिलाओं के खिलाफ होने वाले अपराधों के लिए उन्हीं को देशी कहने लगेंगी तो इससे निश्चित ही आरोपियों का मनोबल बढ़ेगा। साथ ही इससे भारतीय न्याय तंत्र से पीड़िता को न्याय मिलने की उम्मीदें टूटेंगी बल्कि अपराध होने के बाद पीड़िता अपराधियों के खिलाफ शिकायत करने से भी कतराने लगेगी।
