पंजाब के मोगा में एक नाबालिग लड़की का रेप हुआ। लड़की के पिता ने लड़के पर केस दर्ज़ कराया और लड़का गिरफ़्तार हो गया। लगभग दो साल बाद जब लड़का ज़मानत पर जेल से छूट कर आया तो लड़की से मिला। दोनों को एक-दूसरे से प्यार हो गया और दोनों ने शादी कर ली। एक बच्ची पैदा हुई लेकिन कोर्ट ने लड़के को रेप का दोषी मान लिया। अब लड़की चाहती है कि उसके पति को रिहा कर दिया जाए क्योंकि अब वो उसकी बेटी का पिता है।
पहली बार में पढ़ने पर ये किसी फ़िल्म की स्क्रिप्ट लगती है। हालांकि लिखने वालों ने इस 'वास्तविक कहानी' से भरपूर छेड़छाड़ की है। पर असल कहानी इस स्क्रिप्ट से कहीं ज़्यादा दिलचस्प है। एक कहानी, जिसमें अपराध है, प्यार है, जुदाई है, नफ़रत है और कानूनी दांव-पेंच हैं।
तो कहानी कुछ यूं है...
मौजगढ़ की सुखजिंदर और नूरपुर के पलविंदर दो अलग-अलग गांवों में पले-बढ़े, लेकिन उनका स्कूल एक ही था और यहीं दोनों ने एक-दूसरे से कुछ वादे किए। "वो मुझे स्कूल के समय से ही प्यार करता था। शुरू में मैं नहीं करती थी लेकिन वो इतना प्यार करता था कि धीरे-धीरे मुझे भी उससे प्यार हो गया।"
दो महीने की बच्ची की मां सुखजिंदर उस समय नौवीं में थी और पलविंदर ग्यारहवीं में। दो नाबालिगों का प्यार लेकिन प्यार में भरोसा था। उसी के सहारे सुखज़िदर ने सबकुछ पीछे छोड़कर पलविंदर का हाथ थाम लिया। सुखज़िदर जट सिख हैं पलविंदर मज़हबी सिख परिवार से।
"मेरा भरा-पूरा परिवार था। मां-बाप और बड़े भाई वाला परिवार लेकिन मुझे प्यार नहीं मिला। मार-पीट, गाली-गलौज। ये सबकुछ होता था उस घर में। एक पलविंदर ही था जो मुझे प्यार करता था। तो मैंने उसका हाथ थाम लिया। मैं उसके साथ भाग गई। अपनी मर्ज़ी से।"
जिस समय पलविंदर और सुखजिंदर घर से भागे उस वक़्त दोनों नाबालिग थे। साल 2013 में ये दोनों नाबालिक मोगा से भागकर दिल्ली आ गए। दिल्ली में दो महीने साथ रहे। उधर लड़की के घरवालों ने पुलिस को ख़बर कर दी थी तो पुलिस तलाश में थी। दो महीने बाद दिल्ली पुलिस को ये नाबालिग जोड़ा मिल गया। पुलिस उन्हें अपने साथ लेकर मोगा पहुंची। सुखजिंदर के पिता ने पुलविंदर के ख़िलाफ़ एफ़आईआर दर्ज़ करवा दी थी। जिसके बाद उसे हिरासत में ले लिया गया।
सुखजिंदर कहती हैं कि मैं बहुत रो रही थी क्योंकि उसके बाद जो होना था, मुझे उसका अंदाज़ा था। "मेरे घर वाले मुझे जबरन अपने साथ ले गए। मैं उनके साथ नहीं जाना चाहती थी। मैं पलविंदर के साथ ही रहना चाहती थी लेकिन उन लोगों ने पलविंदर के ख़िलाफ़ मामला दर्ज़ करवा दिया था। मुझे मारा-पीटा और धमकाया। कोर्ट में ज़बरदस्ती बयान दिलवाया कि पलविंदर मुझे भगाकर ले गया था और मेरे साथ रेप किया।"
अब यहां कहानी में ट्विस्ट आता है...
दरअसल, जिस समय पलविंदर और सुखज़िदर घर से भागे थे, दोनों नाबालिग थे लेकिन दिसंबर 2013 में जब पुलिस ने उन्हें पकड़ा तब पलविंदर बालिग हो चुका था। 18 साल एक महीने का बालिग। पुलिस थाने से मामला कोर्ट पहुंचा और पलविंदर को जेल भेज दिया गया।
सुखजिंदर बताती हैं "पुलिस के सामने तो मैंने वही कहा जो सच था लेकिन क़रीब पांच महीने बाद जब सेशन कोर्ट की कार्रवाई शुरू हुई तो हर सुनवाई से पहले मुझे मारा-पीटा जाता। धमकाया जाता और सिखाया जाता कि मुझे क्या कहना है।"

22 महीने बाद साल 2016 में पलविंदर को हाई कोर्ट से ज़मानत मिल गई। पलविंदर जब ज़मानत पर जेल से बाहर आया तो उसकी ख़बर सुखजिंदर को लगी और उसने उससे संपर्क किया।
"मेरे पास पलविंदर के घरवालों का नंबर था। मैंने उसे फ़ोन किया। इसके बाद हमारी बातचीत दोबारा शुरू हो गई। हमने एक-दूसरे से शादी करने का फ़ैसला कर लिया था। मैं एक बार फिर घर से भाग गई लेकिन इस बार मैं बालिग थी।"
घर से भागकर सुखजिंदर ने पलविंदर से 4 जुलाई 2017 को एक स्थानीय गुरुद्वारे में शादी कर ली। दोनों की शादी तो हो गई लेकिन सुखजिंदर के घरवालों ने उसे हमेशा के लिए छोड़ दिया। लगभग तीन साल हो गए हैं लेकिन सुखजिंदर की अपने घरवालों से कोई बात नहीं हुई। न ही उन्होंने कभी उसकी ख़बर ली।
पर सुखजिंदर खुश थी। ससुर की मौत हो चुकी थी लेकिन घर में सास थी और एक ननद। दो महीने पहले वो मां बनीं, परिवार पूरा हो गया लेकिन बीते 11 जुलाई को सेशन कोर्ट का फ़ैसला आ गया। उसी केस में जो सुखजिंदर के पिता वीर सिंह ने दर्ज़ करवाया था। सेशन कोर्ट ने पलविंदर को सात साल की सज़ा और पांच हज़ार रुपये जुर्माने का आदेश किया है। ये फ़ैसला उसे बालिग मानकर दिया गया है।
सुखजिंदर को कोर्ट का ये फ़ैसला मंजूर नहीं
मानवीय मूल्यों की दुहाई देते हुए वो कहती हैं "अब उसको क्यों जेल भेज रहे हो। अब तो वो मेरा पति है। मेरी दो महीने की बेटी का पिता है। उसके अलावा हमारा घर कैसे चलेगा? कोर्ट ये क्यों नहीं सोच रहा कि वो अच्छा आदमी था, तभी तो उसने इतना सब होने के बावजूद मुझसे शादी की। प्यार भी करता है। और उसने कभी ज़बरदस्ती नहीं की। हम दोनों प्यार करते हैं। तब भी करते थे जब मैं पहली बार भागी थी।"
पलविंदर की ओर से वकील एसएस रामूवालिया ये मामला देख रहे हैं। वो बताते हैं "सुखविंदर के पिता वीर सिंह ने 4 दिसंबर 2013 को पलविंदर के ख़िलाफ़ एफ़आईआर दर्ज कराई थी। पलविंदर पर आईपीसी की धारा 363, 366ए, 376, 380, 411 के तहत धर्मकोट थाने में मामला दर्ज़ कराया गया। वीर सिंह का कहना था कि पलविंदर सिंह, उनकी बेटी को भगाकर ले गया और उसके साथ रेप किया। उस समय दोनों ही नाबालिग थे।"
पलविंदर के साथ-साथ वीर सिंह ने उनकी मां, पिता और बहन को भी आरोपी बनाया गया। रामूवालिया बताते हैं कि पहले तो सेशन कोर्ट ने उसे नाबालिग माना लेकिन बाद में कोर्ट ने अपने ही फ़ैसले को पलटते हुए कहा क्योंकि जब वो गिरफ़्तार हुआ तब वो 18 साल एक महीने का था इसलिए उस पर बालिग के तहत ही मुक़दमा चलेगा।
इस दौरान पलविंदर की बहन को कोर्ट ने नाबालिग मानते हुए बरी कर दिया। ट्रायल के दौरान ही पलविंदर के पिता की मौत हो गई थी और अब जब 11 जुलाई को फ़ैसला आया तो उसकी मां को भी कोर्ट ने आरोप मुक्त कर दिया है।
रामूवालिया का कहना है कि अगर परिवार के लिहाज़ से देखिए तो ये फ़ैसला उनके लिए परेशानी भरा है। अभी जो फ़ैसला आया है वो सुखजिंदर को नाबालिग मानते हुए ही दिया गया है और पलविंदर को बालिग।
सुखजिंदर कहती हैं "मेरे लिए तो हर तरह से परेशानी ही है। मेरे घर पर कोई नहीं है, जो हमें देखे।" सुखजिंदर से जब उनके पिता वीर सिंह के बारे में पूछा तो उन्होंने कहा, "मैं आपको पापा का मोबाइल नंबर तो दे दूंगी लेकिन मैं खुद बात नहीं करूंगी। आप ही बात करना।"
